AN INTERESTING JUDGMENT.
A decision which, in effect, over-rides an order made by His Excellency Me Goveroor exempt ing a tenonent in Yaumati from the provisions of Section 4 (1) (f) under which the landlords were enthic to possession, was given in the Supreme Court this morning by Sir Henry Cowner Gollan, Chif Justice.
Mr. Justice Dyor Ball had pre- "viusly held that he had no power orescind an order for recovery of session which he had made previous to the application to the Governor in Council. The case in which judgment was kiven. this morning was an appeal against this decision.
Mr. H. S. Fitzroy appeared for Lam Cho-yin, the plaintiff and. ap- pelant, and Mr. C. G. Alabaster K. C., and Mr. Eldon Potter K. C. for the Kung Wo restaurant, the defendants and respondents.
“In giving judgment for the re- spondents with costs His Lordship said that in his opinion there were neither express words nor implica. tion i s. 24 of the Rents Ordinance, 1922, that an order made in Council by the Governor could deprive a person of his rights in whose favour an order for recovery of possession had been made.
Mr. Justice H. H. Gompertz intimated that he was in agreement with the judgment and had nothing to add.
Mr. Alabaster asked that in the costs should be included the fees. of the two barristers involved as in the notice of appeal four points had been indicated although actually one only had been taken.
His Lordship: I am afraid as. they have luxuriated in, the em- ployment of two such eminent counsel they must pay for one of them.
