In the witness-box-the No. 1 chauffeur testified that defendant, at East Point Garage on August 20, took out Mr. Beith's two-seater car at 3.45 in the morning. Two Chinese women were him and he had no permission. He did not return til 4.45.

At the previous hearing Mr. R. E. Lindsell had directed the summons to be made out against "The Manager of Brewer & Co." and remanded the case till to-day for a date to be fixed.

When the case was called this morning Mr. Brewer said that he had been instructed to ask for proof of service (of the sum- mons.)
