The retiring Chief Justice (Sir"MORE William Rees Davies, K.C.) sat on the Bench at the Supreme Court for the last time to-day when he delivered hia reserved judgment in the,case in which the Bank of East Asia sued Mr. J. H. N. Mody, the exchange broker, for the recovery of $77,000 odd in connection with a contract with the Banque Industrielle de Chine which be guaranteed.
The Case.
At the hearing, Mr. Eldon Potter, K.C., and Mr. F. C. Jenkin (instructed by Messrs. Hastings, Dennys & Rowley) appeared for
the Bank and Mr. C. G. Alabaster, K.C. with Mr. Campbell Prosser (instructed by Messrs. Wilkinson & Grist) for Mr. Mody.
The Bank sued the defendant for $77,434.86 which they claimed to be due from him as guarantor of a contract made between them and the Banque Industrielle de Chino, dated June 7, 1921, for the purchase by the plaintiffs of £10,000.
