The bank's case is that they ad- vanced to the defendant a total | sum, including interest, of $516,605 against Shanghai Dock, Whampoa Dock and Ewo Cotton shares which, when sold on the defend- ant's failure to redeem them, realised $376,252.56. After this and certain other sums had been credited to the defendant there still remained owing, it Was alleged, the sun, mentioned in the claim.
Evidence about the transactions forming the subject of the suit was given by the manager of the Bank, He said that after it had been pointed out to the defendant many times that the value of the shares was very much lower than the sum advanced against them and re- quests had been made for a further deposit the defendant directed that the shares should be handed over to Messrs. Benjamin and. Potts to be sold on his behalf. The shares were eventually sold- to 11 representative of the Tin Kee firm for $376,252,56, the total brokerage and stamps amounting to $1,791.26.
While Mr. Jenkin was proceed- ing with his cross-examination of the witness this morning, His Honour interposed that counsel's questions appeared to suggest that the bank which had sold these shares in the name of a nominee had it:e taken over the shares.

The Chief Justice said Mr. Jen-- kin's cross-examination indicated that this was a bogus transaction. If the bank purported to sell the shares and held the scrip themsel ves it looked uncommonly like fraud.
Mr. Jenkin replied that if the shares were sold at their full market value to a man who was a trustee of the bank it was not fraud, It was merely a misapprehension of the legal rights of a mortgagee. Later on, Mr. Jenkin asked the witness some questions as to how a certain transaction was put through. "Perhaps," suggested counsel at lust, "you could look it up during the week-end."
