In the case of a scuttled Greek steamer, it was decided that though fraudulent, the owner had no laim, because the ordinary Lloyd "policy does not cover the risk of scuttling; yet, if the ship was mortgaged, the innocert mortgagees can recover from the under wiitera.

In another case, the Judge dismissed the claim of the shipowner for insur ance on part of the cargo of a steamer. appeared that during the voyage from New York, the captain saw smeke issuing from the hold, and turned on high presstre steam.
The Judge held that the underwriters insured against fre, and not against an error in judgment on the part of the captain.
