Dr. Risien Russell esid he saw Major Shandon last May, and came to the conclusion, and he could come to no other, that he was of sound mind. He could not trace any sign tha! Major Shanaon was suffering from hallucination or delusion.
The Judge found that the represent- ations of which Major Shannon com- plained were not made by any agent of the plaintiff company, but by one who was an agent of the lessees who Aold the estate to the company. That being so, it was not necessary to in- quire how far they were true or not. Major Shannon's action west fail on that ground alone.
Furthermore, be failed to repudiste his liability respecting the shares in a proper time.
Major Shannon's claim for 1200, which he said he expended on behalf of the company during a visit to Rhodesia, was next proceeded with
The Judge held that Major Shannon was not sent out by the company, and judgment would be for the company on the counterclaim.
Ho came to the conclusion that Major Shannon went t. South Africa to settle there in order to avoid the income tax which people in England paid. No doubt that was sufficient Reason to drive anybody far beyond the limits of South Africa.
The doctor's explanation had been given for the satisfaction of Major Shannon himself, but it did not or- plain or destroy the absurdity of the claim ho put forward, the unbecoming manner in which ho chose to asseri them, or his insulting manner to counsel in the course of cross-examina- tion.
