a woman were charged with being concerned in performing an illegal operation.
Mr Curtis Bennett, K.C., defending the woman, was putting a question to a doctor as to a statement the deceased woman was said to have made to him as to whether an instru- ment had been used or not, when Sir Richard Muir (for the Crown) objected on the ground that this came within the rule of hearsay evidence. He quoted the King v. Gloucester, and the famous Wainwright murder trial at the Old Bailey. In 1875 in support of his argument...

Suppose a person were charged with administering paison, and a doctor had asked the deceased before her death what she had drunk, and she said, "I took something out of that bottle," he (the judge) would be asked to exclude that answer. He must hold that the evidence was admissible, but he confined his ruling to the particular point raised, The doctor was asked what explanation the patient had given "of her condition," and he thought that was admissible. He did not say it would have been if the question “had been put by the prosecution, but for the prisoner he beld that the statement of the patient made to the doctor in answer to a necessary question was not mere bearsay within the meaning of the rule. He did not say that statements in a general conversation: would be admissible.
Sir Richard Muir said it was a very important decision, which might have far-reaching effects if followed, and he respectfully ventured to submit it. was in confict with accepted authorities.
Mr Justice Lush: You are referring to Thompson's case. I don't think, mry decision is in conflict with that. case. In that case the evidence was excluded because it was a statement by the deceased to a person who bad. no reason for obtaining information made in what I'll gossip.
