IDENTIFICATION QUESTION.
MAGISTRATE'S DUTY TO THE PUBLIC.
The three Chinese charged with the theft of a motor car from a godown in Irving Street were again before Magistrate Ome on Saturday when Mr. Grist, for the defence, submined that he had no case 10 answer on the ground that the car had not been rightly Nertified. Courset said that

that the property should be alleged to be the property of a certsia per- son, and Furthermore, it must be proved that the property stolen was the property of the complainant men-. tioned in the charge. The complain- ant in this case did not claim the car as his.
The Magistrate: He has not had rime to complete his identification of the car. As the charge did not spécify any particular carvor car num- ber. 1 cot drop the case at this joncture. The only thing I amt.com- cerned about at present is that there was a car in Irving Street but now is gone.

Mr. Grist again asked that the case be dismissed.
Inspector Kem suggested that evi dence as to the possibility of a car engine number being changed might be material.
Remarking that he had a duty to perform to the public as well as to the accused, the Magistrate said that' he would remand, the case for a lew days for further enquiries. No doubt if by the next hearing the police heve pot succeeded in getting fresh evi- dence, they would withdraw the charge.
