JUDGMENT FOR PLAINTIFF,

ŠUPREME COURT CASE.

In the Supreme Court this morning the Prisne Judge, Mr. Justice Wood, gave judgment for the plaintiff the case of S. Shabata against Wong Sai Ying, which has occupied the court for several days. The amount involved was $600. The case grew out of the suit of Wang Sai Ying against K. Asane. The former was given judgment and attached $600 in the bands of Yik Fu Man Shabata thereupon claimed that the $600 belonged to him, not Asare, and sued.

His Lordship said:

I propose to do nothing more than simply state what my position on this issue is. My position is that the money is owed to Shabata.j

I propose to enter judgment i

on the issue for the plaintiff and costs. My view is that the coal originally was the property of Shabata and that he had never sold it until it was sold through Yik Fu Man in Hongkong- Judgment therefore for plantiff and costs.

CLAIM FOR DAMAGES.

ALLEGED NON-DELIVERY.

Hearing of a suit for damage for close upon $100,000 began in the i Supreme Court this morning before the Acting Chief Justice, Mr. Justice Gompertz. The plaintiff is Yoen Hop Horg; the defendant, Kaip Cheong Hong. Damages are claimed for the alleged non-delivery of 5000 tons of rough sugar, which the plaintiff as serts be ordered from the defendant.

Mr. E. Potter and Mr. F. C. Jenkin, instructed by Mr. Bowity of Denny's and Bowley, appeared for the plaintiff. The Hon. H. E Pollock and the Hon. E. H. Sharp, instructed by Mr. Davidson of Hastings and Hasting,

appeared for the defendant.

Mr. Potter addressed the Court at -lengthto-day, setting out the plainti's claim. It is claimed by the plaintiff that he made a contract with the defendant for the delivery of the sugar, Im 1919, but that the latter failed to fulfil it. The defen- dant, on the other hand, claims that he did not sell the sugar 10 the plaintiff, and made no contract to that effect.
