According to American patent practice, the claims of a specification shall be drawn independently of one another and each claim specifically set out the several elements of the combination intended to be covered by the claim. include perhaps a combination of a dozen elements, and claim 2 might. involve the same combination with the addition of one or more elements, and before one can appreciate the Įscope of such a second claim, one must by a kind of algebraic process separate out the elements of the first claim. The procedure in this country for a similar invention would be to draft
·elahın 2 as a claim to the "combina- tion claimed in claim 2 having in addition" whatever elements it is desired to add so that this would stand out definitely.

He states: "The case is remarkable because in making this rejection the Examiner shows that he makes his ruling by force of precedent and against his convictions. He then goes on to deal with the decision in Sexton, and finds that the pertinent part of the decision of 1873 as to the form of claira was in fact an obiter dichum. It merely stated that the claim as it originally stood was awkward in form but itself seeins to meet the objection by a Saggestion as to the interpreta tion of the claim and the decision did not held that the second claim, which referred to the first claim, was incomplete, but only that it would be in better form if it were worded independently of the first
