PRIZE COURTS DECEASE AND A HONEYMOON.

MAY SHIPOWNER'S APPEAL BE..

DELAYED BY WEDDINGÉ

An extraordinary application, came. before the President, Mr. Henry Duke, in the Prize Court, when the owners of the sailing ship "Brigo sought to move the court to grant an extension of time in which to appeal from the President's judgment-be- cxuse an agent whom they had sent over from San Francisco to inquire Linto the proceedings, had decided to get married, and had gone on from London to St. Maistry upon his honey-

· moon. ---

The President heard the armTOUNICË- ment with great soleinnlay, and corn- pleted the conjunction of gravity and comedy, romance and tragedy by pointing out that in the last few days he had been urging the speeding-up of all processes with a view to the Sirly decease of the Prize Court, and this intervention of a wedding szer ed like testing the Prize proceedings with a considerable degree of. levity.'

Dr. Dunlop, K.C., appeared for the Shipowners, instructed by Messrs. Thos Cooper and Co., and Mr. Timothy Davies for the Crown, in- structed by the Treasury Solicitor,

Mr. Dunlop explained that the ship owners, Messrs. McNear, Inc., of San Francisco. sought leave for extension of time for appeal to the Privy Council. from Lord Sterndale's condemnation of the vessel, because', the parcel proved to be contraband. The con- Idemnation of the cargo proceeded as- usual in these cases. on inferences drawn by the court from intercepted letters and cables which passed be- tween parties other than the shipown- ers. The cargo having been con- demned the ship was condemned ac- cordingly, because the whole of the cargo was contraband. The value of the ship was £46.000: she belonged. to San Francisco, and she had been released on bail for £46.000, so that: the ship hersell had gone, On Apri 14 1919. Lord Sterndale extended the time for making application for Iesve to appeal. Application was made on July 15 mid-leave was grant ed, the record to be lodged in four months, expiring November 15, Security for £500 was lodged, the solicitors for the shipowners com- municated with San Francisco, and

Ok ferskum kaletters-aand cables which were not before the owners. They found it difficult to follow the reasons for the judgment, and sent over a representative to con- sult the solicitors, and help them.ID make up their minds whether the chances were worth the expense of an appeal. That representative ar rived in London. in November. The Treasury Solicitor extended the time: for lodging the record by two months, but the shipowners' representative, after consulting with the solicitorsy was unable himself to take the respon sibility of deciding whether there should be an appeal or not. St. Moriz Just married. Please use effort to get Dirige exten sion. In these circumstances, said Mr. Dunlop, he was asking the court for further, indulgence, that the time should be extended in order the the claimants in San Francisco inight bave the opportunity of seeing their, repte- sentative when he returned from his honeymoon and from St. Moritz. 1. Mr. Dunlop I don't think so. I think he is an employe of the com- Fpany owning the ship. His name is Herrscher. It was hoped he would be able to give instructions, but the matter is 100 complicated.Itis, one of unusual difficulty. He declines to take on himsell, the responsibility of giving instructions that the appeal should be lodged,
