In the House of Lords, Lords Buck master. Dunedin. Sumner and Philli more heard the appeal of the' owners of the Japanese steamship Касц Maru from a judgment of the Court of Appeal affirming a judgment of Mr. Justice Hill pronouncing that, a colli- sich between the Kaga Maru" and the Malta was occasioned by the facit of the owners, masters and crew of the former. The collision happened at about 2 um. on February 15, 1917. in the Downs, about the Gull Light- vessel reports the journal of Com- merce of December S. The "Malta,'' the owners of which were the plaintiffs in the action, was a screw steamship of 897 tons register and 202 ft. in length and according to the case for the "Malta
she was at anchor and was duly exhibiting the two regulation anchor lights, which were burning brightly. The weather was fine and clear, the wind a moderate to Fresh breeze from about E.N.E., and the tide was stack. Fa these circum→ stances, it was said, the "Malta was run into by the Kaga Mary, which was under way, and was struck by the stem and port bow of the "Kuga Maru on the port side about amidships a heavy blow causing her to sink. The case made by the own- ers of the "Malta" was that the "Kaga Maru" was negligent in nee keeping a good lockout and in not keeping clear of the "Malta" or tak ing proper measures or proper time to do so.
The case of the owners of the Kaga Mary was that whilst the Kaga Maru," a twin-screw steam- ship of 5.847 tons gross register and 445 . in length, was approaching the
