•Stasia" in corsoquence of which it was alleged was due to the negligence of the defendants be
yants.
Mr. E. L. Harropp, with whom was M. de Pac de Marsoulies, "appeared for the plaintifs and Mr. F. Lipson Ward for the defenduris.
Mr. Hartopp informed the Court that he had been told by Mr. Ward that the No. 12 finer had disappear ed, and it was, therefore, as possible for him to be called. In
Capt. Season, master of the "Stasia," recalled, said in consultation. with Mr. Gray and Mr. Buschweiler, it was suggested that it would be a good. "Wea- to employ watchmen for the edgine room, and upon witness. agreeing that the same would be necessary, M Gray called the No. 1 watchman of the Dock and gave-him instructions to engage two watatumen. Witness understood the 'mor were supplied by the. Dock and paid “by them. He would not here thought of dismissing the without first con- sulting the etholiadis, to whom he would have referred my compfairs ha had had to wikSU MANA
When the Stamïa " was taken out of the dry dock the work remaining-ol be done consisted of a “number of small items in addition to an auxiliary motor which had to be put in." "Wit- news considered that all the workmen employed on the ship were employed by the dedants and he gave no authority to the chief engineer to make any arrangments" for hiring war fit - imen.
Mr. I A. Dennolly, of Messra. MacKenzie & Co. Ltd., agenta for the owners of the vessel," said he knew nothing about the employmen of the engine room watchmen and as far as he could rememter no Bill was ever presented to him for payment for their services.
Mr. J. Gray, in charge of the Ia-' ternational. Dock, or the defendants said he had given oviderce în consec- tion with the fire. before the French Naval Court of Inquiry. No Növer- ber 14, the day of the fire, there were no more repairs to be done to the vessel, to his knowledge. Witness detailed the work that had been done and stated that the dynamo' which had been in repair had been in position two days before, but he did not know whether the electrical installation was in full working order on Novem ber 14. The verbal, agreement in con- nection with the men who assisted the chicl engineer of the Stasia" (since dead) to overhaul the engines was zrada 'twm de iltema dayu alias_the_Tes• sel went into dock. The chief engi neer remarked that the engines want- ed overhauling, and witness replied that his men had no experience in that sort of work on motor engines, but the chief engineer, said that if he could have the men he would super- vise the work. Witness did not post
watchmen in the engine roem and did aot, know if any watchmen wero sa posted. There was, however, an:az+ rangement with Capt. Svenson that witness should get the No. 1 watch- man to obtain two watchmen for the work. The defendants supplied their servants with candies when required and would supply their workmen with candles for a ship like the Stasia." for use in the engine-room if the chief engineer required it. The chief en- gineer In this case, did require it, and when witness asked for electric hand torches the chief engineer faughed and told him to use candles.
Cross-examined by Mr. Ward:-- The vessel was a twin screw schoon- er, fitted with Bolinder oil angines, each with two cylinders, barning heavy fuel oil. They were known as Hot top" engines, because there were bulbs on top of the cylinders which brought about ignition through their being beated by means of kere- sene blow lamps, which were started. with spirit. The Bame would be a naked Rame.
Describing the engine room of the Stasia
as be first saw it, the wit ness said it was very dark and las possible to work in without using artificial light. When he first saw it, it was the filthiest engine poom:he had ever seen in his life. He never had any instructions to clean it up and it remained in the same condi- tion during the whole time. The Aith consisted of oil droppings from the working of the engines, clly waste,'! Boct, etc., all of which was indamis mable. The Hrst time he saw the chief engineer he was in the engine room carrying a candle. Witness was Introduced to him and he said "My, (Continued on Page 6.)
