In the Commercial Court, King's Bench Division, Mr. Justice Bailbache delivered judgment in the action by the British India Steam Navigation Co. Ltd. against Mr.R.H. Green and other underwriters of Lloyd's and the Liverpool and London War Risks In surance Association, Ltd., of Liver. pool, to recover for loss of the vessel under a policy of marine insurance-

Mariana Plaintif were the owners., of the vessel, and they insured with

the Insurance Association against loss by war risk, and with the Lloyd's under- writers against usual marine perils, including perils of the set. The s.s- Matiana whilst one of a convoy in the Mediterranean, steaming without fights at night, ran on to the Keith- Reef. Some cleven hours later she was torpedded. Attempts to tow the vessel off were unsuccessful, and" eventually she was abandoned, and breaking her back was submerged and lost.

Lloyd's underwriters said, the loss should not be borce by them under their policy and the insurance com- pany put in a similar plea.

His Lordship, in giving judgement, saidThis case raises again the now familiar question whether the loss of the steamer is to fall on thei marine or the war risks of writers. The Matiana was one of four steamers proceeding under convey from Alexandria to the UK. She and, I think, the other merchant- steamers were carrying a cargo of cotton. At midnight on the 1st May, 1918, when in the Mediterranean, she ran on to the Keith reef. After lying there some few hours she was torpedoed. Efforts were made" to get her off, but failed. There was a gale on the 5th May, and she became a total wreck. I find, as a fact, her position was hopeless from the first.. and that even if she had not been; torpedoed she would still have been a total wreck. There were two policies. one dated the 24th day of December, 1917, against marine risks, and the other dated the 13th day of March, 1918, against war risks. The material clause in the latter policy insures against all consequences of hostili ties or warlike operations by or against the King's enemies." "The marine risks of writers say the loss of the Matiana was due to warlike: opérations. The war risks of writers. say the loss was due to a perit of the sea, namely, stranding upon the rocks. I agree with the war risks underwriters, that the loss was due to stranding, and that stranding is. prima facie a marine peril, but as the marine policy contains the usual f.c. and s. clause I must go further, and ascertain whether the stranding. was due to warlike operations, as the approximate, and direct cause. To- sail in convoy is, in my opinion, warlike operation. The assembling of the ships to be convoyed and of the men of war to convoy them, the voyage of the whole totilla, the route chosen, and the precautionary measures taken on the voyage must be taken together as all part of a warlike operation. In this case, the vessels pursued a zigzag course, and were sailing at the time" of the infested area and some 30 miles to the stranding through a submarine--

sorthward of the ordinary peace time course. The stranding happened in the course of this warlike operation and subject to another point made by the war risk underwriters was direct- ly due to it. The other point they... make is that the loss was not due to the warlike operations, but to the:: Enegligent way in which it was carried out by the master of the Matiana or the King's officer in charge or of both. I incline to think that if the stranding was due to the master's negligence the point would be a good".. one. In support of this charge they refer to the fact that the master has stated that he was nine miles north of his reckoning and by that much nearer the rocks. I do not. think there was any negligence in that under the circumstances. The vessels were zigzagging, the night was dark, the vessels were upon an unaccustomed cause, and the currents were variable and of un- known direction and force. Quite apart from those considerations, I do not see that the master was in any way to blame for the position in which he found himself." He was one of four conveyed ships. He was under the orders of a King's officer, and was not responsible for the course taken. His business was to keep his position relatively to the other three ships, A King's officer has given evidence. He has been in charge of convoys, and he tells me that a master must obey orders. He may signal, if he thinks it needful, for permission to execute any manoeuvres of his own, and must walt until permission is given (Continued on Page 9)
