The question for determinating was whether the res pondents were entitled to recover the amount of the choques or any thereof, either as (1) money had been re- of ceived by the appelfarts for the use the respondents, or (2) damigos for wrongful conversion of theares. any of Rs. 1,4,860). Williams Bad acted as Mesura. Dodwell's manager at Colombo since 2005. He held a power of which enabled him to conduct attorney flae businese of the respondents at Colombo, and for that purpose conferred en him wide powers, incinding the draw ing of choques co their bankers. The respondients had transacted business with the appellants, relating in the main to the purchase and sale of produce. The latter had opened a separate account with Willer, who employed them in the purchase and sale of shares. With Williams the appellants thus came into business relations in two capacities: general business be dealt with thea as the respondents' agent for produce, but so far as his dealings in shares were concerned, there were private trans sutions on his own account as principal, and not as agent. He was reputed to have made a good deal of money by lealings of this kind, and he owned shares on which the appellants were able to procure advances for him when he needed then. Williams had bought and sold shares largely in both of what ware known as the rubber booms of 1905

The respondents did claim it, and com- menced an setion on January 10, 1913 to enforce their claim. The learned District Judge held that the claim WAS in reality one for money had and received. The Supreme Court varied the decision of the District Judge By a majority they held that the cause of action arose when Williams's frands were discovered in October, 1911, and that the respondents were entitled to the ertire amout of the four cheques, a totu of Es. 1,458, with interest.
