THE SWISS SWINDLING CHARGE.

"AN APPLICATION FOR " DISCHARGE.

"Tha an extradition provisional warrant, issued by H. E. the Governor. for the extin dition to Switzerland of William Alexande Beot, oh a change of swindling Fr. 10,000, Mt. Lewis (Mesare Johnston, Stokes and Master) on Saturday made an appli cation for the man's unconditiona discharge. If his. Worship referred 'to the treaty, said Mr. Fawis, he would And that no such offence as swindling was mentioned. It was not an extraditable offence made hetween Great Britain and other Powers. Mr. Lewis therefore, al mitted that the Magistrate had no power to detain the man.

The Crown Solicitor (Mr. P. Hodgson) asked if there was any information.

Mr. Lewis said he had before asked fur information in other cases in that Court,

d it had been refured.

The Crown Solicitor said he had no ubjection to Mr. Lewis seeing the informa rior far he had-seen nothing and..keem. ruching of the case. He did not know that it. Lewie was going to take that hne. He thought it ans to be an application for bail.

Replying to Mr. Lewis, the Crown Solicitor said swindling was a very wida turm and included fraud. The charge was wwindling Fes, 10,000 and the police found on the an 18,000 marks and 1,000 Swiss fanca Ho Baked for substantial bail in the sum of 18,000 marks, the balance of the money found on the man, including sovereigna, ti be handed back to him.

Mr. Lewis agreed, and prisoner was eranded until late in the morning.

Bail of Marks 15,000 Allowed.

At the second hearing, Mr. Lewis [! plied for a formal discharge.

Mr. Hodgson said the present watrant did not disclose an extradition case and be couhi not oppose the application. He took it that there was another warrant contain- ing-information awarn to by the German Cogsul.

Prisoner was discharged and surrendered to the Becued warrant,

Inspector Ferrett put in the now warrant. Mr. Lewis said it was not usual to make plan in such cases but he wanted to say at the bateat that the alleged fugitiva did not admit committing any crime within the jurisdiction of Switzerland.

for hall

Mr. Lewis app for said that on the The Crown new, warrant there was clearly an extra. ditable crima and bail must be substantial. The

man was charged with obtaining 10,000 make by faire pretences and the sum of 19,000 marka was found upon him. The aaount with which he was charged should not form the subject of bail.

Mr. Lewis: Why You cannot identify

money.

The Crown Solicitor said the amount of bail must be double the alleged amount At present he know according to practica

"nothing of the merits of the case.

Mr. Wood You mean bail should be 90,000 marks excluding the 10,000 with

which he wan charged.

The Crows Solicitors: Yes.

The ad-

ditional 2,000 marka might form part of another case. I know nothing of the CAIB.

Mr. Lewis: Nor does anyone hore.

The Crown Solicitor: My friend has no right to make that statement, because there are people who do know.

Mr. Lewis said his Worship had to see that lail was at prohibitive. To ask the dsfendant to pay another 10,000 marks whe preposterous. He challenged his friend to Mythatthofence with which he wascharged difer d from the one bae which he had buan discharged. The facts on which the Dew warrant was insized worn the same m on the old warrant. ・・

The Crown Solicitor said that was not so Mr. Lewis: Thon I ask my friend to outline the charge. I am antitied to know. Mr Wood: The question now is one o

bill.

Mr. Lewis pointed out that the police had nearly double the amount in their hands. Money could not be identified, and they could not say if that particular sum of money with which he was charged, Naming he was guilty, was the money he had notained by falas pretences. That

· Imil would be preposterous and defendant would have to remain in jail nutil the Recessary papers came from Switzerland. The paper would have to go through diplomatic channels and there would be the usual red tape and formalities, and defendant would be lo fail for the worst two months of the year. The suggestion of the Crown Bolichur was inhumsu, His Instrzotions wars that the charge bað - basa, brooght against defendant not for committing the offence bat because Es had done something which was not an offence in Switzerland.

Ultimately, bail was fixed at $15,000,
