Dr Ho Kai asked at the Legis jative Council meeting this afternoon :- -Will the Honourable the Attorney General state whether he has any objection to give the reasons which govorned him in net Alling an indictment for manslaughter at the last Sessions in the Portland Street Building Collapse Case?
The Hon. Attorney General said: His Excellency the Governor had already ex- pressed to me a desire that the reasona which governed the Attorney General in mot fling an indictmont for manslaughteri at the recent Sossions in the Prtland Street Building Collapse case should be known to the public.
They are as follows: After the Coroner's enquiry the prosecution obtained im- portant expert evidence as to the construa- tion of the buildings. This evidence did not establish such a degree of negligenco as could justify a prosecution for man- slaughter and in the opinion of the At terney General no jury could possibly have convicted having regard to it. The evidence Also oloarly demonstrated that the main supervision of the work was not controlled by Mr Bird and as a fact the building Contract specifically defined the Architecté to be "Clement Palmer sod
