A DISPUTED CONTRACT.

In the Original Jurisdiction of the Supreme Court this morning, before His ~Lordship Sir Francis Piggott (Chief Justlos} the Holland and Chips Trading Company sued the Tong Tal firm for $2317.23, damages sustained by reason of the defon- dants breach of contract.

Hour Mr. II. E-Pollook, R. D., appeased for the plaintiffs, and Mr M. W. Blade represented the defendants.

The statement of diṣim was to the affect

· that ́defendants entered into a contract with the plaintiffs to purchase 500 bags of apgar, weighing in all 635 32 picats, to be ordered by the plaintiffs from Holland and to be shipped in two leta, one of 195 baga as soon as possible and the reminder one month later. The price was agreed upon a 89.50 per pioni, less two per cent. diasognt. The sugar-arrived in Colony, in December 1905 and January 1900, and plaintiffs requested defendants to take delivery but they refused and subsequently the plaintifs sold the sugar by public "austion, "The contract price was 87778.72; the auction realised $3641.60, thus showing a difference of $157.22 and this amount plaintiffs claimed.
