Mr 0. F. Dixon, who opposed the application, said that the evidence clearly showed that there were grounds for suspicion in connection with the removal of the furniture. If criminal proceedings were taken they would probably ob ain more evidence.

His Lordship held that there was not sufficient evidence to warrant him setting aside the order he made last week. It was not clearly shown that the furniture was the property of the concubine, There was several conflicting statements put for *ward but they were not altogether satisfactory. Ho did not see the necessity to vary the order as ten days only had been given in which to supply information to the Crown on which it would be decided whether prosecution would be commenced or not.

Mr Dixon applied for an extension of time for fling particulars.
