ENGLISH AND AUSTRALIAN
SHIPPING LAWS.
British shipowners will be relieved to learn (says Fuirplay) that the Government have at lougth come to their rescue in respect to the conflict between our maritime law and some of the recent Colonial opact- ments. On behalf of the Government, Mr Alfred Lyttelton, the Colonial Secretary, has proposed that a Conference, shall be.... hold here between home and Colonial ro- presentatives to consider points of difference and to make suggestions in regard to the unification of merchant shipping laws in the United Kingdom and the British Colonies. Matters came to a head on the introduction of the Australian Navigation Bill in the early part of last year; that measure was with. hold pending inquiry into it by a Royal Commission. The Australian Common- wealth Parliament then pushed through the Sea Carriage of Goods Hill, the main object of which was to exclude from shipping documents clauses protecting shipowners against negligence. Our own maritime law leaves shippers and ship- owners free to arrange conditions of contract, with the result that as an almost 1370 invariable rule charters and bills of lading are qualified by negligence clauses, Free- dom of contract is thus secured to the parties, to their mutual convenience and benefit.

When the shipper grants the negligènce
clause, the shipowne- reduces his rate of freight correspondingly, and with this sav ing in hand the shipper is able to insure his goods, and to do so more economically with underwriters, than by paying the shipowner the higher freight which the owner would hayo to demand if he took the nogligence risk upon himself. For years the London Chamber of Commerce tried to upset this arrangement, but when the | Chambor found that it could not have thin
both ways its c'amorous agitation subsided, and nothing has been heard of it latterly, | The Australiang, dominated by trade union aims and views, wore more thoroughgoing. The fruit shippers complained that by reason of the negligence clause they could not fix liability on the shipowners whose vessels carried their perishable cargo.

The Shipowners' Parliamentary Com- mitton's letter points out that not only in regard to the negligence clause, but in many other respects, the Australian Navigation Bill runs counter to the Imperial Act and current regulations. For instance, clause 38 proscribes a scale according to which every vessel must be wanted, which differs considerably from the practice of shipow. ners in this country, Clauso 208 requires that the loss of every British ship happen. ing in any part of the world shall be notified ·| to the Government of Australia. Part IV. of the Bill, dealing with unscaworthiness, load-line, inspection of provisions, and survey of ships in the Colony, applies to all British ships, but not to all foreign ships) It applies only to foreign ships carrying passengers or cargo from Australia to any port in the British dominions; forolgn. shipa carrying passengers and cargo from Australia to foreign porta, are not subject to it. Foreign ships will therefore be free from the serious expenses which are thrown on British ships and thus the latter will,
by the ac fon of a British Colony, be handi-
capped as against foreign countries,
