You an Elder!'
Samo good stories of elders and kirk treasurers were on tap at the ex-procentors' social. The kirk elder is always thought a legitimate target for the humorist. The stories that are told at his exponse aro endloss. Everybody knows, of, course, the man who seemed to have no qualifica tion whatever for the office, but discovered at last that he could objeck. Another chestnut that keeps cropping up is that as the minister's man in the kirk session who, when some burning question was under discussion, asked What is

CURIOUS CASE AT SHANGHAI.
The N.-C. Daily News of the 5th inst. reports:-In the German Consular Court yesterday Mears Ellinger & Co., British merchants of Manchester, sued "Mesars Meyerink & Co. of Shanghai, to recover £1,000-damages alleged to have been sustained by plaintiffs in consequence of the Improper lending by defendants of plaintiffs' privato telegraphic code to a mumber of a rival firm. The finding of the Court was as follows:-
The petition of the plaintiffs is dismissed with costs for the following reasons:—
1.The Court rules that by reason of the plaintiffs sending to the defendants the code in which it is expressly stated 'this code is a private one' and in con- sequence of the defendants having kept and used this code that an implicit [im- plied?] agreement existed between the plaintiffs and the defondant according to which the defendants undertook to keep the cede book secret and not to divulge the
contents to others.
The defendants therefore would;be Tablo for damages if such have occurred.
(2) In the present ouse there is to proof
that actual damage has been sustained
The fact that the mpetitor after inspe tion of the Code is in a position to save
telegram expenses in a similar manner as plaintiffs may be deplorable for the latter but does not imply actual pecuniory loss, and it is further the opinion of the Court that the Code has not been rendered value. less by the indiscretion of the defendants because a knowledge of the Code does not imply the discovery of any business secrets of the firm. Therefore the compiling of a new code is not necessitated by met on Phe defendunts
Tho N.-C. Dady Nerra munkes the follow ing comments. A learned Judge neu wittily remarked that many a judgment seemed sound until the reasons for it were given. It may be otherwise with the decision of the Gorman Court at Shanghai on Friday, in a ease of great interest to merchants, which case is fully reported elsewhere. fact that a private coile is deemed necessary. by NO many firmes convinces that, in case such ende loses its privacy by the in- discretion of an agent, the said ngont has deprived the proprietor of a costly, and therefore valuable, assot. The renewal of that asset, entailing fresh cost, is surely a case of damage. However, while the German Court did not think so, it is satis- factory to note that their decision makes it clear that it is incumbent upon agents or firaus to respect the privacy of edes en trusted to them for use exclusively in deal- ing with the proprietors of such codes, Tual merchants will agree with them that A public code is us useful as a private cod

The suggestion has been made that the time has now come when Hong- kong should have a Country Club to which members could resort for week-end holi- days or permanent residence. We do not know that definite steps have been taken to establish a new institution; but if the anggestion is taken up by few leading men we see no reason why it should not come into existence within a reasonable period.
