A Decison in Manila. Judge Ambler in Manila has given judgment in the case in which J. Clifford Wilkinson sued for an injunction restrain- ing the firm of Erlanger & -Melanger the
use of the name * Tansan' for a certain

the ground that the word 'Tansan' is WHY DID YOU TEACH ME TO LOVE YOU SO, descriptive and not a proper subject of trade mark.
In the course of his judgment the learn. ed judge suid-The evidence before mo shows that the word Tansan' is a Japan- ese word meaning 'soda' or 'carbonic acid,' and I am inclined to think that either of these words alone is not descriptive of carbonated mineral water, even in our language. But even if this is not the case, the word 'Tansan,' either in an English- speaking country or a Spanish-speaking country, is descriptive of nothing, but is simply an arbitrary jargon of letters, and as such I think the subject of trade mark when applied to mineral water, or in fact to anything else.
It looks to me as if the defendants were seeking to take advantage of the reputation enjoyed by the plaintiff's water, by imitat- ́ing us closely` as they might the plaintiff's
trade mark.
Counsel for defendants submitted to me, without argument that the label adopted by his clients was not so nearly like the plaintiff's label as to deceive the ordinarily carefal purchaser, and he undoubtedly, from his manner, believed that I would say it was not. But counsel perhaps overlooked the circumstances under which mineral waters are purchased and drunk, 16 the most careful man does not take
tho Ramo examination when he buys! mineral water as he does when he buys medicine or many other things of more moment, and I am constrained to my that I think the general appearance of de- fendants' label, taken in connection with the word Tansan' appearing upon it, is calculated to deceive, and I believe that the average purchaser of this character of a commodity would not and should not be required to so carefully observe a label as to prevent him from buying the one when be preferred the other, and that the well- known, trade-marked * Tansan' goes almost without the saying.
The plaintiff did not choose a combinn. tion of letters for his trade mark which even in the Japanese moans * carbonated mineral water, or anything of that kind, but even if he had I think the combination of letters would be the proper subject of trade mark and not be held to be merely descriptive in a country where the mean- ing of this combination of letters was whol- Jy unknown, and where the letters forined a more arbitrary, meaningless word, and 1 therefore fool obliged to overrule the motion to dissolve the temporary injunction.

Who can say positively whether a certain medicine has the power to cure some particular malady or not without giving it a trial?
When the friend of Mr Michael Fitzpatrick, of 60, Forbes Street, Woolloomoolo, Sydney, N.S,W,, advised him to take Mother Seigel's Curative Syrup for the cure of indigestion, be backed his advice with some excellent reasons— excellent because his judgment of that remedy was based upon actual experience of its merit. Saye Mr Fitzpatrick in a letter written on the 20th June, 1902: For many years I suffered terribly from indigestion and bilionsness, and spent pounds on doctors' medicines and so-called cares; but without avail. In those days I had Lo appetite, and the little food I ate turned sour on my stomach, causing severe attacks of heartburn. I was also troubled with paius in the chest, violent headaches, and habitual con- stipation. In fact, at one time or other I suffered from most of the symptoms which characterise a sluggish liver and impaired digestion, My worst affliction, however, was a total inability to obtain sufficient sleep. I would go to bed feeling worn-out and sleepy, but as soon as my head touched the pillow my brain would become tunaturally active, and I would think of every kind of subject, and roll and toss about botween the alicets, listening to. the Fish Market Clock as it chimed hour after Hour, until all my nerves were in a quiver.

is becoming increasingly difficult in this country owing to the diminishing value of silver. The import trade is receiving a serious check owing to the enhanced prices in silver required for all foreign commodities and the difficulty of doing business with a medium which is
so constantly and violently fluctuating.
5. Some remedy must be found and that immediately. The only remedy seenis to be the establishment of a gold standard in China.
Hongkong and the Treaty Ports who are bleeding to death financially. They are unable to help themselves, and those who could at least make an effort to help them refuse to do so. In China, the situation is less hopeful than in Hongkong, in our opinion, because
