not go to the extent of making a protest and gave Secretary Hay to understand that
if Barrett were appointed his government would make no objection. But the hint was suficient.
A cablegrain was sent to Barrett some days ago asking him if he would serve at Tokio. Another cablegram was sent fox. day, it was understood, indicating to him that a declination of the proffered honour would relieve the Administration of some embarrassment. Secretary Hay said to- day after the Takahira interview that he did not understand why a young man with Barrett's fine position should wish to change for the comparativo obscurity of the Japanese mission.
No one is able to discover the real reason for Japan's objection to Barrett, unless it
gave
is because that Government believes more prominent man should be accredited to Tokio. Barrett was well received in Japan recently and before leaving here A dinner to Minister Takahira. It was conjectured that Parrett incurred the displeasure of the Japanese by advocating the exclusion of laborers of that race from the United States, but this was denied fatly by an attache of the Japanese mis- sion, who said Barrett waa personally popular with the Japanese.
Senator Bard is keeping a close watch on the situation and will press the claims of Dr Chester Rowell for the place if Barrett declines the appointment, as expected. The entire California delegation has signed- an eloquent indorsement of Dr Rowell, and they are ready to call on the President in body to present it. Senator Hanna, whose influence procured the appointment of the late Minister Buck, told Senator Bard that he had no successor to Buck in mind, but that he might look around and find one. Bard is trying to enlist. Hanna's support for Rowell.

We admitted at once that one or more of the plaintiffs being a minor or miners, this release was not a valid legal document, but we hold that, the defendant having been bound to take some sort of acknowle gment from the plaintiff's when the estate was distributed "in accordance with the forms of the will in April of 1893, if the accounts show that there has been no misconduct on our part, then the release will hold good.
The Chief Justice-He must be kind. Mr Sharp He is a relative. The Chief Justice--An uncle ? (laughter). Mr Sharp-said the account would show whether the plaintiff had acted fraudulent ly or not. The question of costs, in view of the fact that no inquiry had yet been made, should be left until after the account was gone into. Then if misconduct on the part of the defendant was proved ho would be liable not merely for these costs, but probably for all the costs in the action.

Hongkong Tides. The Tide Table given below has been compiled by the Nautical Almanzo Office in London from the result of the audyals of observations taken by means of a ̈au- tomatic tide-recording machine in the Wa- ter Police Bagiu nt Tšim Sha Tsui during the years 1887-8-9.
The zero of the table is Low Water Or dinary Spring Tides, which has been found to be 2 feet below mean sea level.
To obtain the depth of water on the tide range at the Victoria Naval Yard add 5 ft. 7 in., and on the gaugo at Lamont Dock, Aberdeen, add 12 ft. Fin. to the light pivan in the table,
