the statute (34 & 35) of Henry VIII (c) took the jurisdiction in matters of bankniptcy out of the hands of the cara- mon law, and before the statute of Anue (4th, o. 17) introduced into English Inw that novel expedient of whitewashing a bankrapt sod diséharg ing him from all furclier abilities for debté contracted previous to his sur- rendering his whole effects and conform- ing to the low of bankruptcy. We have finally seen that the Chinese law makes no distinction between traders and non- traders in its provisions regarding debtors, and that the mode of procedure against insolvent debtors in Chim, based as it is on the principle of nalic mited vicarious responsibility, and involving corporal punishment and tor ture, makes the position of an insolvent. debtor, and thereby of merchants gens. rally, so truly terrible, that bankruptcy is practically cashewed with fear and trombling and that, onses of insolvency are by all but universal practice seriled out of Court by liquidation or composi• tion through arrangement with the most importunate of the creditors ⠀⠀

Such has been the practical position of a Chinese merchant, and such the commercial law and usage of China for the lust ex centuries (since the Yue Dynasty) and virtually for the Inst two thousand years. The effect of it has been, in the course of centuries, to mould the character and instincts of Chinese merchants accordingly and to imbue them with habits the net result of which has been to keep commercial morality in China on a comparatively high level.

That loyalty to Queen Victoria, those Anglo-Chiuse notions which Sir John Pope Hennessy found it politic to ascribe to the Chinese

Chinese-subject and as a sident of a British Colony,

In the first instance Chinese merchants brought with them to Hongkong that inherited national love for commercial combination, which developed, record- ingly, trades unious and guilds here in Hongkong on expatially the same pat tern on which these institutions are bailt up in Ching, Asthe local Govern ment could not be expected to recognize these institutions offcially, nor assume the same central guidance of them as the Chinese Government undertakes in China, the innate instinct of the Chinese merchants of Hongkong supplied within Blev years after the establishment of The Colony, and ever since maintained the supply of this deficiency of central organ by the appointment of a General Committee in which each guild and trades union has its representative, an nually elected by ballot. This Central Committen, which by its casual assump- tion of the management, in addition to its onder inctions, of a general-Chi near Hospital, came eventually to the surface in 1870, when it was officially recognized and constituted by Ordinance as u gorporation, under the name "Tung wah Hospital Committee, existed at along unknown to the Government, and exists to the present far, us a re- PASSENORES Rriving in Hongkong, or any presentative Vigilance Committes of all other persons who may desire to con- the Chinese guilds and trades unious in sult the files of local, China, Japan, respondence with the Chicere Govern
