Now, the vessel in question is an American steamer, and, as she would be under the jurisdiction of the U. S. Consul of Cauton while calling at Whampoa, it is difficult to understand the equity of this refusal. Besides, the U. S. Consul at the port of Whampoa would be responsible to bis own Government if he permitted any irregularities in the shipment of the passengers. Every Consul of the U. S. is bound to certify to every Chinese passenger leaving China, that he or she is a free passenger; and such a rule if we mistake not, has been in force longer than the laws under which Go- vernor lennessy now claims his extra- ordinary powers.
