TONG LONG HIN 6. Poas. KA SEIN and Ornans, 3490--This was a suit on a pro- missory note given in March 1878, Mr HL Dennys appeared for the plaintiff; fr Brereton for the defendants, the Koong Bhoo Loong shop. It appears that a sum

His Lordship eald that on careful con- sideration of this case he found he must give judgment for Mr Brereton. It had not been proved in the case-Mr Dennys had simply asserted it-that a custom exist tang firm would be made liable on a ed among the Chinese whereby the partners guarantee for any debt, whether it was in- ourred in the ordinary course of the firm's business or not, simply assuming that the chop of the firm was on the guarantee. But even if there had been evidence that there was some sort of a general notion amongat the Chinese that such were their labilities he believed the Court would have held that it was a bad custom and that it could not be maintained as not being consonant with reason and common
No partnership could be made liable, that is the whole of the partners could not be made liable on the guarantee by the act of one or more of them without special knowledge on the part of each Judgment would therefore be given against Chun Chun Bang, and Poon Ka Shin with costs. He did not think the case was in such a state as to allow him to give judgment against the other defondant. In that case there would be judgment for the defendant without costs. His Lordship further said he bad been making some enquiries and he was told that an impression existed among the Chinese out of which a curious question might arise, that was, that they under. stood that if a certain paper was stamped and guaranteed, that the principal then was no longer liable.
sense;
Mr Dennys: That is the Chineso ander standing; the surety is always the first person looked to.
His Lordship said this was a purely Chinese impression.
Mr Brereton remarked that this was precisely the question he had endeavoured to raise in a case before his Lordship the
other day.
His Lordship: But in that cass the man admitted his liability,
Mr Dennys said he had a similar case in which the man entirely admitted his Habi- lity. The case would not, however, come before his Lordship; he believed it had been settled.
Gr Mur and ons. v. Ho Tr Hu, FOR AD- MINISTRATION.-This was a peculiar case.
The suit is really brought simply as one of administration, the estate consist ing of a junk. There is also concerned in It the possession or guardianship of some children. Mr Dennys appeared, for the children of the son of the first wife of the deceased; Mr Stephens for the adopted son of the second wife of the deceased. The third wife ("the Annamite wife" she was called) of the deceased had four chlidren, and two of these are now with the plaintiff and two with the defendant A cane was reported in the Police Court the other day in which a charge of kidnapping was brought against the plaintiff by the defendant, lo which Mr Stephens (without whore consent it had been instituted) ap peared and had the case postponed for a wook explaining to the magistrate that this
cisa was before thla Court,
Mr Dennys said the children now with his client said they preferred to remain
with him.

Witness: No, you never fought with me. The eighth defendant asked witness if he was sure that he was the manager of the house,
Witness: 1 am aure you are the manager, as I saw you noting in that capacity three different times.
His Worship said that he was not satis fied with the evidence of the gambling in. former, respecting the first and eighth de- fendants; his description of them in the application for the warrant was most un satisfactory. Be would fine them $10 each for being found in a gambling house, to default of payment fourteen days with hard labor.
His Worship, addressing Inspector Rivera, said he should have summoned the man who reate the house where the gamblers were arrested.
The Inspector informed the Magistrate that he would summon him!If his Worship wished it to be done, but it had never been done before.
His Worship: Then it, ought to have been done.
ANOTHER GAMBLING HAID.
Inspector Cradock, stated that about 7.80, last evening, he went to No 68 Square Street and went up the stairs. The door of the room where the prisoners were arrested was open. He passed into the room and crossed over to the cook-house door to prevent escape. The room was fitted up with the regular gambling im plements, and had a strong upright door. Any one standing at the door of the room could not see that gambling was going en inside, as there was a screen placed across the doorway. The door has two spring locka and is made to fit into the wall.
The whole of the defendants were in the room when he entered it, and when he got over against the door of the
