John Brittell, an ordinary seaman of the Iron Duke, said that the deceased was on the foretop mast below the crosstrees. He bud just been to the royal mast-head and was coming down. Witness was close to the deceased and suddenly heard him take breath. He seemed to have missed his hold and then fell. He saw his lege strike the topsail yard as he fell on to the deck.
