of this Government to a premature ex- tinguishment. We state this as a chief reason only, because we believe some delay was occasioned in the passing of the Ordinance through a happy thought. occurring to somebody at the last no- ment to embody it in another messure of wider application. It may also be added that His Excelletoy the Governor reduced the fine of 84,020, imposed on the Company on the occa sion to which we are referring, to the nominal one of $100. Clearly, then,
it was not considered desirable that the restrictions of the Ordinance of 1876 should be imposed on the trade of this Colony with Canton and Macao, or that the Hongkong Canton and Macao Steam- boat Company should be fined the pre- posterous sum of nourly 11,000 dollars for carrying the full number of passen gers which, there is good reason" to believe, their boats were capable of ac.......... commodating.
Under these circumstances, why should the Captain Superintendent of Police, the Harbour Mastor, or whoever is responsible for this prosecution, suddenlý start into activity, put the condeinned

into operation, and inflict a serious blow on one of the most important commercial é undertakings we have in our midst. There has been ample outlet of late for the energy of the custodians of our lives and property, while sparing the Steam- boat Company, and the proprietors of the rival, but equally unoffensive estab lishment, represented in the Tchang. Nor were the Police under any greater obliga tions to enforce the provisions of this Ordinance than they were to carry out certain mintary enactments for the sup pressions of nuisances of various kinds which flourish in Hongkong, or for the carrying of lights and passes by the Chinese. By the laws of England any person, excepting a Jew, who works on Sunday, excepting in cases of necessity or charity, or ories a cabbage for sale in the streets, is liable to a penalty. These are laws, however, that it is not consid ered expedient to enforce. It seems a pity that a similar view was not taken of the Ordinance of 1876, considering its faulty construction, and the peculiar dir cumstances under which it still happened to be in existence,
At the same time, it is a little surpris ing that the Company again allowed. themselves to drift under the penalties" of the enactment. doubtless are the difficulty of keeping the passengers down to a stipulated number at certain times in the year, and their disbelief, after the proceedings in the Legislative Council since their pro vious conviction, that the provisions of the Ordinance would be enforced. The offence committed by the Company is, at all events, not a very serious one. It

shown pretty conclusively in evidence yesterday that they had not carried more passengers than they could accommodate with safety. Convenience is a matter for the passengers to consider, and not the Government. The extract
from the Chief Officer's log, rend in Court, must also be regarded as evidence that efforts had been made at Canton to keep down the number of passengers received on beard, but that the limited orew on board were powerless to prevent the straggling, tenacious, mass of huma nity from crowding into the steamer, A general proof of the Company's desire to keep on the safe side of the Ordinance was afforded by their doubling their fares immediately after their previous convic tion. We are convinced there is a general desire that H. E the Governor will treat the Company as leniently as possible under the circumstances, and that a small fine will be again inflicted.
