LARCENY ON BOARD SHIP.

Young Akwa, a sorvant on board the German barque Friedrich, was sent to one month's hard labour for stealing certain articles of alothing and a piece of brass, the properties of Captain Georgo Dan, the Master, and the Chief Officer. The ar- ticles were found in his bunk, and he said he had placed them there for safe keeping,

Mr Hayllar said that the meme was not a oharter party. He agreed with his learned friend on some points, but there was no oharter party in existence. The plaintiff was out of Court because he objected, to the agrooment.

Mr Hayllar objected.

THE CHINA HAIL.

By Mr HayllarThe Captain is very anxious to get his ship home. As far as the actual water displacement is concerned, it did not matter what cargo she had on beard. Some cargoes will be more trying to a ship than others. I knew the vessel buld carry 830 tons dead weight; but the Captain did not agree that he would carry 830 tons dead weight. I heard the conversation between the Captain and Mr Pastau; there was no stipulation as to the quantity of sugar she was to carry; the cargo was to be part sus gar. The words "good risk in the local insurance offesa" is in nearly every charter

|

A great deal of time was ocoupled in going into the details of the accounts between the parties,

His Lordship enquired" whether any criminal proceedings were likely to result from the mase.

Mr Dennys said that two of the men, who said they were actual witnesses to facta, went up to the Magistracy to lay an in- formation. They were told to come another time, but they came down there and wore kept as witnesses, and the Information was not laid. That being so it was considered better to let this pase be finished before any Father proceedings were taken. He did not think himself the men were in any way bound to prosecute. The whole question was one for the Crown. The Crown was now made aware of the exact statements of these men, and if it wished to prosecute it could do so. These men could not afford to waste money in other proe edings.

His Lordship said he made the enquiry because anything he might say in his judgment might be held as prejudicial in subsequent proceedings; if any were taken. Mr Wotton said a summons had been taken out by Koza.

Mr Dennys said he had nothing to do with that proceeding.

Judgment was then resaved?.
