During the trial of this case, the question of the limits of the prison was much discussed and it was held that the superintendent's house was not part of the prison. The prisoner was convicted for breach of prison, and how long he was sentenced to his Lordship could not re-

The Chief Justice thought the putting of the prisoner into the solitary cell was a do- mestic punishment; he had committed a breach of the Gaol discipline and was put there to be subdued. If he persisted in the breach of dissipline, he could be flogged every time he did so until he was subdued. He did not think that his offence could be called breach of prison,

The Attorney General pointed out that the prisoner was not indicted for breach of prison but for attempt to break out of his cell with intent to escape,

The Chief Justice asked for the Attorney General's authority for such an indictment. The Attorney General submitted that the cell the prisoner was lawfully put in was his prison.

Mr Justice, Snowden supposed a caso where a prisoner was ordered to be put in stocks in the gaol, and he attempted to bre k-away from the stocks; would that be a breach of prison ?
