Mr Bailey replied that sa the Consul, he would take steps to have the amount paid him first before he would part with the ship's paper, on which he had a lien.

The same despatch gave the definition of the word "mariners" which included all seafaring men engaged in the navigation of a vessel, from the highest to the lowest. This despatch was addressed to Consul Allen in 1866.

ROSINA;" JUDGMENT.

MOTION FOR

This was a motion on behalf of the holders, Messrs Adamson, Bell & Co., of a bottomry bond against the American vessel Rosina, for a deciée of the Court for the

sale of the vessel under the bond, given in favour of one Mr Pral in Sydney, who endorsed it over to the present promovents. The Hon. George Phillippo, the Queen's Advocate, instructed by Messrs Sharp, Toller, and Johnson, appeared for Messrs Adamson, Bell & Co.

Mr Kingsmill, instructed by Mr Dennys, appeared for Capt. C. W. Haneen, the master of the vessel, to claim prior rights over the promovent's claim, from the pro- reads of the sale for wages and disburse- ments on account of the ship.:

Mr. Kingsmill continued his argument by quoting from Wheaton's International Law to show that by the oomity of nations a contract followed the law of the place at which it was made. The master's contract of service having been made in Boston, American law-ohould prevail in the trial of this case, while, on the other hand, the bot- tomry bond having been execated in Syd- ney, English law should prevail But the master's contract being antecadent to the

hood, should have preference, and, as by the law of the United States, as well as England, the master in a claim for wages, wa precisely in the same position as a mariner, and should have priority over "the bond-holder,

At the close of the learned advocate's argument, bis Lordship proposed to call the master to depose to certain facts which the Court should like to know, if both sides consented.

GEO. F. TRAIN'S NEW PAPER, AS

The Hon. G. Phillippo then addressed the Court on behalf of the promovents, He rolled his case on the personal security which the Captain had given in the bottomry bond which was sometimes given without this personal security. But here Capt. Hansen secured the advance with

The distinction in this case was the master gave no personal security, the advanos being made on the ship, freight and cargo, The ruling here was that the master should have priority over the bond-holder, and in his claim for wages, he was placed in the same position as a seaman. This was, however, so far as the exigencies of the asse would permit, so that where the crew claimed for wages alo, they should have preference over the master. Several other cases, such as the Wm. F. Safford and Edward Oliver, were likewise oited in support of the contention on priority of liena.

The further hearing was then adjourned till to-morrow (2nd) at 10.30 am.
