Mr Kingsmill applied for bail. The Court asked if the offence charged was a bailable offence here.

Mr Kingsmill replied that it was; con spiracy was only a misdemeanor.

Mr Magistrato pointed out that it was n conspiracy to defraud.

Mr Kingsmill said the charge wout no bigber then that of avlling goods to the Company by a person in its employ at a higher rate than they could be got elsewhere. It was a fit subject for dam

H. E. Guvernor Ussher arrived in Labuan on the 21st April. Dr. Troncher, the late Colonial Secretary of that Colony, has taken his departure for Europe. His fine stack of catile (some 500 heads) have been disposed of to the Spanish troops garages, riaoning Salu. There is a report that ex- Governor Low intende returning home soon, but it is not generally credited. His only daughter is with her husband (Geo, Pope Hennessy) at Barbadoes.

THE ALLEGED CONSPIRACY TO

DEFRAUD.

The charge against Robert Duncan and M. J. Rozario, for conspiracy to defraud the Hongkong and Whampoa Deck Com pany, was proceeded with before Mr Rassell At the Police Court this morning.

Mr Brereton appeared for the prosecu-

tion.

Mr Kingsmill, instructed by Mr Dennys, appeared for the defence of Mr Deacon and Mr Handley, instructed by Messrs Stephens and Holmes, for Mr Rozaria

Ng Sang, compradure to Mesara Douglas Lapraik & Co., was again put into the boz and examined by Mr Brereton-Whas monthly payments were made, for people in the Docks, Asing, Mr Rozario and some

Mr Brereton begged to differ fram Mr Kingawill's remarks. What he had ani referred to a single case of selling at a higher rate. There was another phase in the charge, that of obtaining money by false pretences.

Mr Kingsmill contended that, even with this second aspect, bail should still be

allowed.

The Magistrate asked if false pretence was a bailable offence,

Mr Kingsmill replied that it was, being | only a misdemeanor,

The Magistrate said that, under the Ast of Viot. 11 and 12 C. 42, there were two classes of inademeanors, in one class of which the Magistrato was bound to ad- it to bail, while in the other it was op- tional False pretente was one of those of fences which was disuretionary to him to allow bail or not, and what his Worship bad said before on this subject would apply bere. He did not think he could take the responsibility of allowing bail, and this was a matter which should be properly left to the opinion of the higher Court

Aftor further discussion, Mr Kingsmill urged, at another reason for bail, that the regimen or rule in the gaol in regard to persons on remand was very severe. They

were treated like prisoners..

The Magistrate vald he understood that men nu remand were only kept there for

safe custody.

kept in a cell and deprived of all comforts. Mr Duncar could not even speak to his wife without some one being present.

others came. They presented me a com. pradores order and I told the person having it to sign on the back of it. When Asing received payments he always went to a side-table not far from me, about five 13st, and put the money on it. Sometimes I heard Asing having conversations with Mr Rozario at the table, but what they said I did not hear. When they talked they had their sides towards me. I did not see what sing did with the money. The conversations lasted five or six minutes and both then left together. Entries of pay- ments were made by the Dook compradore. By the Court The Dock people have always been paid at our office, but for the last two years, a separate comprador has beea-employed-for-the-Docks. I am secu-complain of, the complaint should be made rity for him, and that is why I keep the

money in my own office.

Mr Wardin Grey, of the Gaol, who hap pened to be in Court, was asked by the Magistrate what the rule was in the gaol about this matter.

Mr Grey replied that every one on remand was put into the remand ward, ono for Chinese and one for Europeans. It was aot a cell but a ward.

A FALSE CHARGE.

Mr Thomas McLaughlin, second officer of the British barque Candia, was brought up on the charge of stealing a pair of shots from a shoe-mskor who had gone on board to sell his wares. The charge turned out to ba false, and the complainant was fined $5. The defendant bought the shoes and told the complainant to wait till the Cap tain's return when he would be paid. The defendant then went into the hold to his work and did not come up again until the Polica arrived. The Magistrate made some enquiry as to how the defendant came to be arrested instead of being summoned, and it resulted in the Captain Superinten dont giving orders to the Police that com plainants of this kind should be recom mended in future to apply for summonses
