BRITISH CONSULATE, CANTON, 22 Junsary, 1868. The undersigned has the boner to make public, for the information of the British community at this port, the accompanying despatch from His Excellency Sir Rathar- ford, Alcock, K.C.B., H.M/s Minister in China, with its e eucioare, urging on British subjects the uccessity of great caution in the acceptance from the Chiness of written garantoos commonly called "Security. Copy, Circular No. 15.

PEKING, October 27, 1887.

S18,-I have to call attention to a noti fication issued by Mir Consul Medhurst, copy of which is herewith enclosed for your information. It conveys a useful warding to British subjects as to the naccity of great caution in the acceptance from the Chiness of written guarantees commonly called "Security Chops" The difference between the Chinese law and customs and aur own on this head renders them in great degree, as experience has shewn, valuoless, and for any security they prac tically afford useless without thers in other and oollateral security. It would be well therefore euaura publicity to the enclosed within your jarisdiction, as a fair exposi tion of the actual conditions which limit the value of such guarantee in any appeal to the Chinese authorities for execution.

Your obedient serrant, (Signed) RUTHERFORD ALCOOK. D. B. Hoberizon, F., C.B., B.D. M.'s Consul, Canton,

[ENCLOSURE.]

The Undersigned desires to call the silaution of British ubjects in this part to the necessity of exercising great caution in the acceptance. From the Chincue of written guarantees, com mmonly called "Security Chups." The experience of the past two years, during which numerous auits have been instituted in this Consular Court, with almost unvarying if success, against Chi nese sureites who have failed to fulfil their written gaartees, sufficiently proves that ach documente, iniis part of Chios at Ruy rat are comparatively worthless for the purpose for which they are given and takennamely, the additional protection of the obliges from risk or Joea. This is to be accounted for, not from any informality in the documents themselves, bat from the fact that the Chinese are in the habit of regarding a surety rather in the ght of a person who comes forward to recommend his principal, or to assist hins towards the attain ment of some cherished object, anelt a loan, place, & than.se an indiviņual who "bizida" itself to stand to all intents and purposes in be atea of his principal and to fulfil all his obligatious with and for him, to prevalent is this qualified idea of the position and duties of a guarantee, that it is a cormon practice bere for a surely to receive a consideration for these of his brane, with the understanding that no individual responsibility fellows upon the pro cess. The Chinese authvities moveever have been found to support this view, for they have. always persistently avoided acting upon the principle that a surety is to be regarded sa equally responsible with his principal for all the cftigatious entered into by the lattery which the former undertakes shall be fulfilled; and they plead in excuse thist Chlume Judicis practice, wiilet admitting the liability of a struty for the residencies, Bengal, Macts and defaults of his principal, is nevertheless dras, Bombay.

always careful to treat & surety when involved through the miscaduct of his principal with peculine fenity, and will not allow of his being secuted or pressed until ability of the pincipal to nikke good alt defaleations for himself is despaired of, no matter how stringent ar how positive dhe torms in which the guarantee may be drawn up
