The Acting Attorney General was present by special summons.
The minutes of Council held on the 23rd October, were read and approved.
The Governor laid on the Table a letter, dated 22nd October, form the Honorable the Colonial Treasurer to His Excellency in respect of the Draft Ordinance "for Licensing and Regulating Emigration Passage "Brokers" which was read to the Council by the Honorable Member, at the request of His Excellency.
His Excellency proposed the recommittal of the ordinance "for Licensing "and Regulating Emigration Passage Brokers," amended at the meeting of the 21st October. The proposal was carried, the Honorable the Chief Magistrate dissenting.
The amendments were as follows:
In clause 7, the words "And upon each contract Ticket there shall be paid by the Passage Broker issuing the same a Fee of Twenty five cents, which Fee the Emigration Officer is hereby authorized and required to receive and take; such Fees to be paid over to the Colonial Treasurer to be applied to the Colonial Revenue" were proposed to be expunged from the Ordinance. The proposal was carried, the Honorable the Chief Magistrate dissenting.
It was then proposed and carried, the Honorable Mr. Jardine dissenting, that the Fee in clause 3 for a Passage Broker's License, be Two Hundred Dollars, instead of one Hundred.
The Honorable the Acting Colonial Secretary proposed the insertion of the word "Silver" between the words "Current Dollars" which proposal being put to the vote, all the Members dissented.
The Preamble of the Ordinance was then amended and the Ordinance, as finally amended, passed the Council (The Honorable Mr. Jardine alone dissenting) being No. 11 of 1857. The Ordinance to be printed and published in the next Government Gazette.
The Governor laid on the Table the reply received from the Naval Commander in Chief, adverted to at the last meeting of Council, on the subject of the Prostitution Ordinance which being read to the Council, the Draft Ordinance "for checking the spread of Venereal Diseases" was brought to Committee and Clauses 2 to 11 were seriatim read amended and passed the consideration of Clause No. 1 having been postponed.
Council adjourned till Tuesday the 10th November at Noon.
