exercise of powers or carrying out of duties in the New Territories (other than New Kowloon), the powers under this Ordinance may be exercised and the duties under this Ordinance shall be carried out by the District Commissioner in lieu of the Controller of Stores.

6. Any person who contravenes any provision of subsection (1) of section 2, or subsection (1) of section 3, or who brings into the Colony or takes or removes more sand than is prescribed by the permit, or sand from or to any place other than the place or places, if any, prescribed in the permit, shall be guilty of an offence and shall be liable, on summary conviction, to a fine of one thousand dollars and to imprisonment for six months.
