MENTAL HEALTH

To amend and consolidate the law relating to mental disorder and its treatment and to make provision for the reception, detention and treatment of persons of unsound mind.

Short title

PART I

PRELIMINARY

This Ordinance may be cited as the Mental Health Ordinance.

Interpretation

(1) In this Ordinance, unless the context otherwise requires-

"approved social worker" means a social worker approved for the purposes of this Ordinance by the Director of Social Welfare; (Added 46 of 1988 s. 2)

"certified patient" means a person who is detained in a mental hospital in accordance with the provisions of section 36;

"chairman" means chairman of the tribunal; (Added 46 of 1988 s. 2)

"Correctional Services Department Psychiatric Centre" means the Correctional Services Department Psychiatric Centre set apart as a prison under section 4 of the Prisons Ordinance (Cap. 234); (Added 37 of 1973 s. 2)

"Court" means the High Court and any judge of the High Court;

"Director of Social Welfare" includes an assistant director of social welfare;

"guardian" in relation to a person under the age of 16 years includes any person having charge of the person under the age of 16 years and the Director of Social Welfare and in relation to a person received into guardianship pursuant to an application under section 33, the person in whom the powers specified in section 34(1) are vested; (Amended 46 of 1988 s. 2)
