57. Where a licensee is convicted of an offence against these by-laws, after having been previously convicted of a similar offence or any other offence against these by-laws (whether in his capacity as a licensee or otherwise), the magistrate convicting him may, in addition to or instead of imposing a penalty authorized by by-law 56, recommend to the Council that the licence of the licensee be cancelled or suspended under section 125 of the Ordinance.
58. The offences specifically designated for the purposes of the application of section 86A(1)(a) of the Ordinance are those involving a contravention of section 83B(3) of the Ordinance and by-laws 5, 22, 36, and 48.
