the opinion of the Surveyor General, necessary or expedient temporarily to remove or discontinue the use of such tramway or any part thereof, the Surveyor General shall, before such tramway or any part thereof shall be temporarily removed or the use thereof discontinued, give to the Company fourteen days' notice at least of the necessity or expediency of such temporary removal or discontinuance,

(2.) Immediately on receipt of any such notice, the Company may, subject to such conditions and regulations as the Surveyor General may from time to time make, construct in the same or any adjacent road, and, subject as aforesaid, maintain so long as necessary, a temporary tramway in lieu of the tramway or part thereof so removed or discontinued, and the road on which such temporary tramway is laid shall, subject as aforesaid, be maintained so long as necessary by the Surveyor General at the expense of the Company.

19. Any paving, metalling, or material excavated by the Company in the construction of its works from any road under the control of the Surveyor General may be applied by it, so far as may be necessary, in or towards the re-instating of such road, provided such paving, metalling, or material is, in the opinion of the Surveyor General, fit and proper to be used in the re-instating of such road, and all surplus paving, metalling, or material not used for any of the purposes mentioned in this section shall be the property of the Company, and shall be removed by it.

20. For the purpose of making, forming, laying down, maintaining, renewing, altering, adding to, or removing any of its tramways, the Company may from time to time, where it is necessary or appears expedient for the purpose of preventing frequent interruption of the traffic by repairs or works in connexion with the same, alter the position of any mains or pipes for the supply of gas or water, or any tubes, wires, or apparatus for telegraphic or other purposes, subject to the following restrictions; that is to say,-

(1.) before the Company alters the position of any such mains or pipes, tubes, wires, or apparatus, it shall obtain the written assent of the Surveyor General to such alteration;

(2.) before laying down a tramway in a road in which any mains or pipes, tubes, wires, or apparatus may be laid, the Company shall, whether it contemplates altering the position of any such mains or pipes, tubes, wires, or apparatus or not, give seven days' notice to the company, persons, or person to whom such mains or pipes, tubes, wires, or apparatus may belong of its intention to lay down or alter the tramway, and shall at the same time deliver a plan and section of the proposed work. If it appears to such other company, persons, or person that the proposed work will interfere with or cause damage to their or his works, or apparatus, or any difficulty in the maintenance or working thereof, the matter shall be settled by the Surveyor General.

(3.) the Company shall not interfere with any pipes, wires, or apparatus, or do any work in connexion with telegraphic or other purposes, or pipes, except under the superintendence of the Surveyor General or other officer appointed by him for the purpose, and to his approval; and shall make good any damage done to such pipes, wires, or apparatus, or other works, and pay the expense of such superintendence and approval.
