TRADE MARKS REGISTRY
98. The Trade Marks Ordinance, 1954, is based on the United Kingdom Trade Marks Act, 1938. The Register consists of two parts, Part A for distinctive marks, and Part B for marks which are not regis- trable in Part A but are capable of distinguishing the goods of the applicant and have been used in Hong Kong for not less than two years. Registra- tion in Part A gives full rights of protection, in Part B modified rights. Registrations are valid for seven years, but may be renewed indefinitely for further periods of fourteen years. Defensive and certification trade marks may be registered, and a person other than the proprietor of a mark may be registered as a registered user. The procedure and forms. to be used are set forth in the Trade Marks Rules, 1954.
Move of Registry
99. During the weekend of the 24th-25th August 1963 the Trade Marks Registry moved from the West Corridor of the 11th floor of the Central Government Offices, West Wing, to slightly more capacious accommodation in the West Corridor of the 6th floor of the same building.
Applications and Registrations
100. In view of the Colony's importance as a shopping and trading centre and of the rapid rise of its light manufacturing industries, business- men both foreign and local are very much alive to the value of registering their trade marks in Hong Kong. With the Colony enjoying another year of active and expanding trade it was therefore not surprising that the year should produce a new record number of applications. In fact, at 2,151, the number received exceeded 2,000 for the first time and was 157 more than the 1962-63 total. Of these applications 2,138 were for registration in Part A of the Register, and 13 for registration in Part B.
