It will be shortly ascertained how an outrageous abuse and usurpation of authority, such as we have hinted at, can be reconciled with, and will he admit ted as "a benefit to the service, and ati enforcing of "the grand principles of discipline.”

We leave the subject hers for the present, with lile fear that any thinking and right judging mind, oft reading the article on which we have com- imented will take it for one jota more than its worth, and with perfet confidence in the justice of the ultimate decision.

On the July 1844, at Whanghia, a trea- ty, political and commercial, was concluded between the United States of America and the Chinese Empire, the contracting partics binding themselves by certain clearly defined and most important obligations.

Itecent occurrences in Canton must natural- ly lead to the enquiry how far the stipulations of this treaty have been carried into effect, this enquiry being of weighty consequence, af.

But this state of things be quite incompatible with the terms and pint of the treaty, con- mined in Article No. 21, as follow viz —

*Subjects of China who may be guilty of my * orămiziki nci towards ckizens of 1979 United Sta- tes, shall be arrested and puinshed by the Cluftese authorities according to the love of Chine. And Citizens of the United States who may com- * mit any crime in China, shall bo zubject to be tried and punished only by the Cousof of ather public functionary of the United Blater, therefo aukarized according to the laws of tlle Ontled Butes. And in order to the prevention of all controversy and disaffection, justice si be equitably and impartially administered on both sider,

Hat it would appear, by an unaccountable omission, that the United States government have not authorized ther Consuls or other func tionaries to try and punish their citizens for crimes committed in China,

A transient glance at the correspondence between Keying and the United States Consul, respecting the riot in Canton on 8th July 1846, when several Chinese were slain will show, the difficult and false position in which the American officials are placed. It being notóri- ons that several Americans were in the fray. His Excellency, in his letter, trusted that the said Consul would personally enquire into and

ascertain the causes and intricacies of the late disturbance, so that the matter might be settled according to the treaty. But the Consul mère- ly replies, " at the time of the rict, several Arbe-

ricans went out, but, as I, the Consul, was "at home prepáting to defend my own house, "I am ignorant who fired on the Chinese, and as the disturbance arose with an Englishman, it was not my duty to go out and repress it."

It is palpable that the Consal is not required to mate his own personal knowledge on the subject, but he is most properly called upon by the Chinese Commissioner, in the direct:ferria zn of the treaty, to hold an official enquiry, sol the homicide of Chinese subjects, in which

impli American Citizens liad been notoriously i cated, but to this most important request he makes no reply whatever, feeling, doubtless, over the poisons of his

paper. of importance.

But how stands the matter with the United States government, Is it not chargeable with insincerity, of most enlpable negligence? Art cle 18th of the above treaty is as follows :-

"The Chinese Government will not hold itself; " responsible for any debta which may happen to be "due from subjects of China to citizens of the United States or for frauds committed by them, but Citizens of the United States iniy seek redress in law; and on suitable representation being made to the Chinese local authorities through the Consul, "they will cause dve examination in the promises, and

* take all proper steps to compet satisfaction. But

la bringing this subject before the public, we earnestly hope it may also fall under the notice t of the British authorities at home, and that most time may be lost, in obtaining from the Ga verndients of the United States and of France, the establishment in China of juristich ing full cognisance of Civil and with ample delegated powers to and punish offenders, —and thus we to demand, at least so far as Brius property, and persons are interested.
