Setoo, who, it may be remen- bered, was wounded in a duel near Portsmouth, and expired subsequent to an operation performed Mr Liston, and other eminent practitioners. evidence was the sume as that given upon the trial of Mr Pym for the same offence, which took place some months since before Mr Justice Erie. Mr Cockburn proposed to cross-examine the medical witnesses, with the view of showing that the deceas. did not die of the wound, but of the treatment of
the former trial, refused to receive, holding that if treated by medical men bona fide, according to the a party received a dangerous wound, which was best of their indgruent, and the party diet, the per- son causing the wound was responsible for the depu of the party. Mr Bacon Plait pursed the same course, and ruled that the evidence was inadmissible.
