Captain Vaux recollects the Corsair in Oct. Jast. He sailed on the 3d October from Macao and had a whole sail breeze all the way to Na. mos and nothing like a gale-did not then see the Corsair was five days going toNamoa-if his ship had made twenty inches of water in any wind he then had, he would have said she was not fit to take a perishable cargo, but these gales are partial-Witness would think there was no gale at that time-between Hongkong and Macao there seldom is any bad weather except in a typhoon-if a vessel made twenty inches be tween Macao and Hongkong should think she required repair-Ships of that clase that are sea worthy may make half an inch an hour-There was a very heavy gule on the 24th October- after being two days at Namoa, witness went to Woosung-some specie was shipped in the Cor sair from Woosung. back if his vessel had three feet of water-Opium would suffer serious damage by being long in water. Bombay opium is more liable to be damaged than Calcutta.

Captain Mann being sworn declares he is com mander of a vessel-was at Chusan in October last has been on the coast for the last six years never experienced a violent gale between Ma- cao and Hongkong except in a typhoon has not heard of a violent gale there has not seen a gale which should make a vessel take in twenty inches of water-if she did so, would consider she want- ed some repairs,most likely wanted caulking- having a perishable cargo on board would try to discover where a leak was-twenty inches should not damage a cargo-it is usual to have two feet of dunnage three feel of water would cause damage having three feet of water, witness would have put into port to ascertain where the leak was-it is not an unusual thing for a sharp vessel to make 18 inches a day.

Cross examined. The water between Macao and Hongkong is generally smooth among the is- lands-would go into the nearest port to discover a leak-should have gone to the same place as the Corsair. If he could stop the leak would go on, if not would turn back

The Attorney-General.shortly addressed the Jury and read an authority stating that an-in- surance extended from the time the goods were taken on board until 24 hours after the vessel is

in port.

The Chief Justice stated that the inability of the Captain would not injure the policy. The only thing therefore for the jury to decide is whether the vessel was sea worthy when she left Macao, and also when she left Hongkong. The written part of the policy expresses the last will and intention of the parties, the other which dis- agrees with it seems to have been left inadver- tently. His Lordship then recapitulated the evidence on bothsides, and the Jury after a short

· consultation returded a verdict for the pursuers.
