Such at least is the opinion of those conversant with the particulars of one or two transactions which have been brought before our notice. The judicial powers intrusted to the British Consuls at the five ports have not heretofore, so far as we are aware, been clearly defined. or their precise limits understood by the British residents at these ports, They are aware that for offences committeds in China they are amenable to the laws of their native land, and that to some extent the Consuls-who may know litle or nothing of such matters— have the onerous duty of trying criminals, and inflicting fines upon those who break the es- tablished regulations of the port. No. 21 points out very clearly the nature and extent ofa Con- sul's judicial duties, and the document merits the consideration of those, who may have occasion to visit or reside at either of these ports,
It will be observed that three courses of pro- ceedings are prescribed and that the power vest- ed in the Consul individually is not great. The first course is that of a summary decision, as in a police court or a court of requests. Over this portion of his judicial jurisdiction the Consul has entire control, but the offences upon which he adjudicates can only be those of as trivial nature. The circular is very clear upon this point, we read, "all crimes of a trifling nature under whatever legal denomination they may be classed, may be safely disposed of suin- marily by the Consul, and sufficiently toned for by punishment within the units prescribed by the ordinance (No. 7 of 1844) for the sole jurisdiction of the Consul.”

Much dissatisfaction continues among the stone masons and others employed in build ing. One gentlemen, who has been greatly annoyed by a contractor throwing up the contract after the building had commenced, made arrangements with a secord party to finish the work one of the people employed by the first contractor appeared on the ground and endeavoured to intimidate the new hands, when he was handed over to the proven, the Chief police, and the offence being Magistrate very properly fined him forty dol- lars with a short imprisonment.

The third course pointed out is for crimes of the greatest enormnity; such as at home are usually reserved for a Judge of Assizes.
