We have diverged from the object which we have at present in view. In laying the following corresponitence before our readers, and in respect- fully drawing the attention of His Excellency to the letter from the firm of Lindsay & Co, and the reply from the Surveyor General, we would sub- mit that the latter is not a suitable reply to the formër, and that the referring to the stringent re- gulations of a very illiberal lease, is not paying that regard to the interests of the colonists, which we feel assured, it is the wish of His Excellency that all heads of branches in the public service should display. We really hoped that, the urba nity which is now discernable in the principals of many departments, would extend itself to all, and that there should be. that desire to oblige-when no interest is injured by it-which comes so will from those who hold official appointinents,

The purport of Messrs. Lindsay & Co's letter- will be better understood when we mention thai, at the land sales of last January they purchased certain suburban allotments. Through these lots there rons a ravine, part of which they filled up at great expence previous to building the B galow which now stands on the ground, but all of which it is necessary should be leveled before their plans of improvement can be carried out. Contiguous to the ravine, and upon their own land there stands or stood—a mound of earth, the leveling of which would enable them at compara- tively a small expence to fill up the revine. Un fortunately for the owners of the ground this mound catches the eyes of the Gentlemen con- nected with the survey department, and as they require material of a similar description to level part of a road which is in the course of formation, they instruct their coolies to carry it away, per- fectly regardless of the injury they are doing to the property of the firm in question. We do not mean to assert that, legally speaking the Surveyor General hau overstepped, the lease, within whose boundaries he seeks a shelter; but we aver that had that part of his lotter, which we have printed in itaties,been as follows,it would have been in much better taste, more -in keeping with the office le holds, nod we trust more satisfactory to His Ex- cellency,

Gentlemen, I regret to hear that in carrying away part of the earth from your allotment I am putting you to inconvenience or expence. I assure you that a no time would I in the slightest degree injure private property by carrying ont to the letter.the regulations of the land lease,and I will instruct the overseer employed on that section of the road to take materials for rais-

ing his levels, from the ansold Government property, or from lots which will not be injured by its remo val.--I am, &c. &c.

This we submit is the tone and the spirit which anght to be displayed by the Surveyor General, when a similar application is made, supposing

that legally speaking he is entitled to injure priva- te property, under the pretence that it is for the public benefit. In the present instance the tak ing away of this earth, was not for the public be- nefit, as it could of been had elsewhere, where no man's property would have been injured, and we think a liberal interpretation of that clause of the lease which reserves to Her Majesty all Mines, Minerals, Quarries &c. &c. with such material as may be required for the making of roads, and

· which concludes with the words,"" thereby doing as little damage as possible to the said " proprie tors, would scarcely warrant the injury which has now been inflicted."

We have fortunately little knowledge of law; we place the matter on the solid principles of equity, to which according to our limited come prehension it is utterly opposed. Thero is yet another reason why we disapprove of the tone of the Surveyor General's letter. That Gentleman is of course aware that, recent events have to some, extent raised feelings of emnity among us, and we hold it is the duty of every man, who has the in- terest of the colony at heart, to endeavour to recon- FOR cile all differences—to avoid every action which ean in any degree check the establishment of mutual confidence, between the rulers and the ruled, and their hearty co-operation in the arduous task of breaking the shackles which have been placed upon the prosperity of Hongkong. The destruction of private property by a public servant, and his pettish, if not impudent letter, can in no degree tend towards that happy unity of action and of interest, which is so much required, and in as much as it has a contrary tendency, we think it bighly censurable, imprudent, and altogether on- becoming.
