received from the most eminent Houses in Eng

to deliver the opium also, on receiving payment in cash, or eccurities ; noither of which, however, were forthcoming Captain Lyons said," I have no orders but to receive the opium Having remained six days at Tongkoo In low hours' sail from Macao) in order to afford Capt. Lyons an opportunity of communicating with Hoorjeebhoy, and no answor being forthcoming,

have, in connexion with their Establishment in Captain McIntyre sailed back with his opium to Ma- Calcutta, completed most extensivò arrangements cao, and informed Hourjoobhoy that he had not deli, with the first Houses in England and France for vorod the opium to Captain Lyons, on the ground of receiving regular connguthents of overy "desoiup- his declining to pay for it. He then sold the opium totion of goods and they are now prepared to oxes, other parties, and left Macao in the prosecution of his voyage. The case sooms perfectly clear. It is, we bo love, the invariable custom of the trade, that opium shall be vaid for in hard cash on delivery in many cases previousto delivery. Captain McIntyre had not only "custom" in his favor-but also on an express agree ment, that the opium shauk be paid for in cash on delivery. The contract was not fulfilled, solely through default of the said Heerjeebhoy, who, in an English court of justice, whould have been compelled to in plement it. What followed? On the return

of Cap- McIntyre to Macao at a future period, he is suddenly scized by a file of soldiers, dragged before a person calling hingelf a Portuguese Judge, and compelled to name an arbitrator and give security to abide by the award! During his abse.ce these arbitrators made an award in favor of Hcerjecbhoy to the amount of 8799 dollors, as joss of profit! although the market price of opium had not varied in the least The judgment of Sir Erskine Perry will be read with interest.
