By His Excellency Sir JOHN BOWRING, Knight, LL.D., Governor and Commander-in-Chief of the Colony of Hongkong and its Dependencies, and Vice-Admiral of the same, Her Majesty's Plenipotentiary and Chief Superintendent of the Trade of British Subjects in China, with the advice of the Legislative Council of Hongkong.

An Ordinance to Regulate the Storage of Gunpowder within the Colony of Hongkong.

1855.] Whereas the Lives and Property of the Inhabitants of this Colony are endangered by the improper Storage of Gunpowder in the Town and Harbour of Victoria and elsewhere; and whereas Ordinance No. 1 of 1848, entitled "An Ordinance to Regulate the Manufacture and Storage of a certain Description of Gunpowder within the Colony of Hongkong," does not sufficiently provide against such Danger, and it is advisable to repeal and consolidate in one Ordinance certain clauses of Ordinance No. 1 af 1855, entitled "An Ordinance to enforce Neutrality during the Contest now existing in China," having reference to Guns and Gunpowder:

I. Be it therefore enacted and ordained by His Excellency the Governor of Hongkong, with the advice of the Legislative Council thereof, That Ordinance No. I of 1848 and Sections IV, V, VI, VII, and VIII of Ordinance No. 1 of 1855, be, and the same are, hereby repealed.

II. And be it further enacted and ordained, That from and after the

no person shall, within Hongkong and its Dependencies or the Waters thereof, Manufacture any Gun, Cannon, or other Machine, which can be used for the discharge of Ammunition, or any Shot or any Gunpowder, or other Explosive Substance of the nature of Gunpowder, or capable of being employed in discharging Cannon, or any Stinkpots, or any Composition of the same or similar nature as that whereof Stinkpots are composed, under Penalty, upon conviction of a breach of any part of this Section, to Imprisonment for a Term not exceeding Twelve Calendar Months, and of a Fine not exceeding Five Hundred Dollars, such Penalties to be accumulative or not at the discretion of the Adjudicating Tribunal.

III. And be it further enacted and ordained, That no person shall, within Hongkong and its Depen dencies or the Waters thereof, Sell, Barter, or willingly part with the possession, under any excuse whatso- ever, of any Gun, Cannon, or other Instrument which can be used for the discharge of Ammunition (ex- cepting always European Fowling-pieces and Pistols of every description whatever), or any Shot, or any Gunpowder, or other Explosive Substance of the nature of Gunpowder, or capable of being employed in the same manner as Gunpowder, without having previously obtained, in each particular instance, a Permit in writing from the Chief Magistrate or any two Justices of the Peace; and such Permit shall state the Nature of the Transaction and the Person to whom the Property is to be transferred. Provided always, that the necessity for such Permit shall not extend to European Gunpowder in quantities not exceeding Five Pounds at one time on any one day, and that any person convicted of a breach under this Section shall be liable to a Fine not exceeding One Thousand Dollars or to Imprisonment for a term not exceeding Twelve Months.

IV. That any person who shall, within this Colony or its Dependencies, without a License for that pur pose being first had and obtained from the Colonial Secretary, have in his possession or control, or in that of his Servants, in any House, Shop, Warehouse, Building, Ship, or Boat, or any other place either on the Land or on the Water, at any one time, in any shape or form, a greater quantity of Gunpowder or Gun Cotton for sale or otherwise than Ten Pounds in weight, shall be liable, upon due conviction before a Magistrate, to pay a Fine not exceeding Five Hundred Dollars and in default of Payment of such Fine, to Imprisonment for any period not exceeding Six Calendar Months, and that such Gunpowder or Gun Cotton shall be forfeited to the Crown.

V. It shall be lawful for the Colonial Secretary to grant to any person whom he shall deem fit and proper a License for the Sale or Keeping in Deposit, within the limits of the towns of Victoria, Aberdeen, and Stanley, in this Colony, any quantity of Gunpowder or Gun Cotton not exceeding

in weight, for keeping in deposit without the limits of either of the said towns any quantity of Gunpowder or Gun Cotton on such Conditions as shall be specified in such License; and any person who shall be guilty of a Breach of any such Conditions shall, on conviction before a Magistrate, be liable to a Forfeiture of his License and of all Gunpowder or Gun Cotton in his possession, and also to a Fine not exceeding One Hundred Dollars.
