An Ordinance to amend the Law of Debtor and Creditor.
[16th April, 1864.]
Whereas it is expedient to amend the Laws relating to Persons who are unable to meet their engagements: Be it therefore enacted and ordained by the Governor of Hongkong, with the Advice of the Legislative Council thereof, in manner following:
Title.
Preamble.
I. This Ordinance unless where otherwise specially provided shall commence and when to commence take effect from the First day of July next, and may be cited as "The Bankruptcy and how to be cited. Ordinance, 1864.”

II. The Ordinance No. 3 of 1846 for the relief of Insolvent Debtors within the Ordinances No. 3 Colony of Hongkong, Ordinances No. 5 of 1846, and No. 2 of 1849, respectively amend- of 1846, No. 5 of 1846 ing the first mentioned Ordinance, are hereby repealed: Provided that every Petition or repealed. Proceeding which shall have been presented or commenced under the said Ordinance, Proviso. before the passing of this Ordinance, shall be carried on and concluded in the same manner as if this Ordinance had not been passed: and that every Offence which shall have been wholly or partly committed before the commencement of this Ordinance, shall be dealt with as if this Ordinance had not been passed: and that every act duly done, and
every adjudication, appointment, order, discharge, warrant or other instrument duly made or granted before the passing of this Ordinance shall continue and be of the same force and effect as if this Ordinance had not been passed: and that no right which has arisen or may arise in respect of anything duly done under the said Ordinance shall be affected by this Ordinance: and that where any act of Bankruptcy, Petitioning Cre- ditors Debt, Imprisonment or any other matter or thing whatsoever shall have taken place in whole or in part before the commencement of this Ordinance, but no pro- ceeding shall have been had or taken in respect thereof before the commencement of this Ordinance, every proceeding in respect thereof may be had or taken under the provisions of this Ordinance, in the same manner as if the same had taken place after the commencement of this Ordinance.
III. This Ordinance shall apply to all persons of full age in the Colony of Hongkong Ordinance to apply whether traders or non-traders, except as hereinbefore ordained.
