HEREAS an action has been commenced
W in this Court at the suit of the above
named John Francis Fawcett against the above named Edward Hercules Duis to recover the Sam of Five Hundred and Seventy Dollars for money payable by the Defendant to the Plaintiff for money had and received by the Defendant for the Plaintiff's use and for money payable by the Defendant to the Plaintiff for moneys found to be due from the Defendant to the Plaintiff on accounts stated between them and a further sum for interest of
moneys due from the Defendant to the Plaintiff and forborne as interest by the said Defendant at the request of the Plaintiff. And it being alleged that the said Fdward Hercules Duis does not reside within this Island or its Dependencies a Writ of Foreign Attachment has been issued returnable on the Sixteenth day of January, 1865, wherein eury Hemsley Severs and William James Bain trading as Severs & Company are Garnishees.
Notice, is hereby given there of and that if at any time before final judgment in this action the said Edward Herenles Duis or any person on his behalf will give the security and notice and tile the apparance or plea required by the Ordinance of this Island intituled "An Ordinance to provide for and regulate process in actions at Law against persons absent from the Colony," the said At- tachment may be dissolved.
