THE HONGKONG GOVERNMENT GAZETTE, 7TH SEPTEMBER, 1867.

FINDING.

The Court, having considered the evidence adduced, conclude:--

First-We find that the Master JOHN WYLIE has been in a state of intoxication whilst in Harbor, but has not been so whilst the ship has been at Sea.

Second-That the Master has not through any drunkenness endangered the lives of any of the Officers or Crew, nor has the charge of abusive language been proved.

Third-In the evidence it has been shewn that the Ethel on the 19th July last struck on a rock marked the Fiery Cross in the China Sea, from which she sustained such damage as to render her return to Hongkong necessary; and we are of opinion that the getting the ship on shore is the result of a want of proper care. The Court therefore adjudicate that the Master JOHN WYLIE be severely reprimanded and cautioned to be more careful for the future.

The Court wishes to express its opinion that the charges have been brought at the instigation of the Chief Mate GEORGE WESTWATER (No. of Certificate 11,671), who at least on one occasion has been guilty of drunkenness and gross insubordination to the Master in the Canton River on the 18th ultimo; and we also consider that these charges have been brought from malicious motives on the part of that officer, and we therefore adjudge him to be severely reprimanded.

Given under our hands this 2nd day of September, 1867.

I agree with this Finding.
