and ROBERT SMITH, THOMAS DAVID

NEAVE, and ROBERT BRAND, Copartners, trading under the style or firm of SMITH, KENNEDY AND COMPANY, Defendants.

WHEREAS an Action has been commenced

in this Court at the suit of the above named Chartered Mercantile Bank of India, Lon- don and China, against the above named Robert Smith, Thomas David Neave, and Robert Brand, trading as aforesaid, to recover the sum of $48,959.18, the balance due upon Six Bills of Exchange each for £2,500 Sterling all drawu at Hongkong aforesaid by the said Defendants. un- der their said firm, upon Robert Smith and Com- pany, of London, and now overdue, dishonored and unpaid, and of which said Six Bills of Ex- change, the Plaintiff is holder, for value and for expenses in and about the presenting and noting the said Six Bills respectively and incidental to the dishonor thereof and for re-exchange on the said Six Bills respectively, and for interest upon money forborne at interest by the Plaintiff to the Defendants at their request, and for money due from the Defendants to the Plaintiff on accounts stated between them; and it being alleged that the said Robert Smith, Thomas David Neave, and Robert Brand, trading as aforesaid, do not reside within this Island or its Dependencies, a Writ of Foreign Attachment has been issued returnable on the 7th day of August next, wherein Logan Russell, of Victoria, Hongkong aforesaid, Mercantile Assistant, is Garnishée.

Notice is hereby given thereof and that if at any time before final judgment in this Action the said Robert Smith, Thomas David Neave, and Robert Brand or any person on their behalf will give the security and notice and file the appearance or plea required by the Ordinance of this Island intituled "An Ordinance to provide for and regulate process in actions at Law against persons absent from the Colony" the said attach- ment may be dissolved.

and Merchant, having been adjudged Bankrupt under a Petition for adjudication of Bankruptcy filed in the Supreme Court of Hongkong in Bankruptcy on the 5th day of July, 1867, is hereby required to surrender himself to Norman Ramsay Masson, Esquire, the Acting Registrar of the said Court at the first meeting of his Cre- ditors to be held before the said Acting Registrar on the 24th day of July instant, at eleven o'clock in the forenoon precisely at the said Court.

Mr. Norman Ramsay Masson is the Official Assignee, and Mr. Edmund Sharp is the Solicitor acting in the Bankruptcy.

A Public Sitting will be appointed by the Court for the said Bankrupt to pass his last examina- tion of which Sitting Notice will be given in the Hongkong Government Gazette.

At the first meeting of Creditors the Acting Registrar will receive the proofs of the debts of the Creditors, and the Creditors may choose an Assignee or Assignees of the Bankrupt's estate and effects. At the Public Sitting proofs of debts of Creditors will be received and the Bankrupt will be required to submit himself to be examined and to make a full disclosure and discovery of all his estate and effects and to finish his examina- tion.

Notice is also hereby given to all persons in- debted to the said Bankrupt or that have any of his effects not to deliver the same but to the Official Assignee, and to give notice to the Soli- citor acting in the Bankruptcy.
